Bye-Laws of the Association of Calicut University Teachers (ACT)

The Association shall be known as Association of Calicut University Teachers (hereinafter called ACT).

The Office of the ACT shall be at the Calicut University Campus, Calicut University, P.O., 673 635.

The aim and objectives of the ACT shall be

  1. To promote advancement of knowledge and to use knowledge as a means for National development,
  2. To work for attaining professional competence in teaching, research and extension works,
  3. To promote and support cultural and artistic activities of the members,
  4. To strive for meaningful integration among the teaching and research community,
  5. To discuss the problems of Higher and University Education and device such programmes and meaningful actions that will facilitate and improve standards of Higher and University Education,
  6. It will discuss and adopt meaningful steps to improve the working conditions of the members and teachers in general and also defend the salient principle of academic freedom, democracy and secularism, and
  7. It will also ensure to protect the professional rights of the teachers.

In order to achieve these aims and objectives, the ACT shall have the right to

  • frame, adopt and amend such rules and bye-laws as the ACT may deem necessary from time to time,
  • to arrange discussions, lectures, study tours, seminars and other forms of meaningful action on the matters relevant to the aims and objectives,
  • to acquire properties,
  • to work in co-operation with other association or bodies with similar aims and objectives, and
  • to do such other acts as may be necessary to achieve the aims and objectives.

There shall be an Executive Committee to conduct the business of the ACT according to the provisions of the Bye-laws.

Definitions:

For the purpose of these Bye-laws, the following definitions are valid unless they are inconsistent with the relevant context:

  • ACT means the Association of Calicut University Teachers.
  • Year means the year from the date of one annual general body meeting to the next annual general body meeting.
  • General Body means the general body of the ACT.
  • Committee means the Executive Committee of the ACT.
  • President means the President of the ACT.
  • Vice-President means the Vice-President of the ACT.
  • Secretary means the Secretary of the ACT.
  • Joint-Secretary means the Joint-Secretary of the ACT.
  • Treasurer means the Treasurer of the ACT.
  • University means the University of Calicut.

Membership

  • The members of the faculties of the University are eligible for membership of the ACT.
  • Application for the membership of the ACT shall be made in the form prescribed by the Executive Committee from time to time and shall be sent to the Secretary and shall be accompanied by the admission fee and annual membership fee as prescribed by the Committee from time to time. The applications for admission shall be placed by the Secretary before the Executive Committee for its consideration and disposal.
  • If, however, the Executive Committee rejects any application for admission an appeal will lie with the General Body, whose decisions shall be final.
  • Membership shall be reckoned from the date of one annual general body meeting to the next annual general body meeting. The annual general body meeting shall be convened on or before 31st March of every year.  Thereafter it shall be renewable every year on payment of the annual membership fees.  A member who fails to renew the membership on or before the annual general body meeting of the year will lose his right to stand for elections and to vote on any matter till he pays the annual membership fee for the year.  He will also loose elected office, if any, held by him.
  • A member who fails to pay the annual membership fee for a year during that year his membership will lose automatically, but shall be re-admitted on payment of the admission fee and the annual membership fee for the year in which he is re-admitted.
  • Any member whose conduct is found to be against the interest of the ACT, such matter may be raised before the general body and a committee will be constituted by the general body to look into the matter and submit the report before the next general body or a special general body may be convened for the purpose in which the committee will present its findings. Then an appropriate action can be taken against the member on the basis of the findings by a two third majority of the members present in the meeting and voting.
  • The membership of a person removed by the resolution of the General Body as provided in clause 7(vi) above, may be restored by a resolution of the General Body provided that such a resolution has the support of not less than 50% of the total number of members of the ACT eligible to vote.
  • A member, who loses his eligibility for membership as per 7(i) above, will automatically lose his membership, but such persons who have lost the membership under this clause can apply for fresh membership as and when his eligibility is restored.

Admission fee and membership fee:

The admission fee shall be Rs.100/- (Rupees one hundred only) and the annual membership shall be an amount fixed by the executive committee from time to time and approved by the general body.

General Body:

  • The General Body of the ACT shall include all members of the ACT who are eligible to vote.
  • It shall meet not less than four times in a year.
  • A meeting of the General Body can be convened by the President, by the Secretary or by the written requisition of not less than 25% of the members of the ACT eligible to vote.
  • The minimum notice for an ordinary meeting of the General Body shall be seven days. However, considering the urgency special general body meetings can be convened by the executive committee.
  • The quorum for an ordinary meeting of the General Body shall be 25% of its membership. If the business cannot be transacted due to want of quorum, the meeting may be adjourned to a date not earlier than 7 days after the adjournment.  For the adjourned meeting, no quorum shall be necessary for transacting business included in the Agenda of the original meeting.
  • All decisions of the General Body shall be taken on the basis of simple majority of the members present and voting unless otherwise specified in the Bye-laws.

 

Executive Committee

  1. The Executive Committee of the ACT shall consist of:

The President

The Vice-President

The Secretary

Two Joint-Secretaries of which one shall be a lady,

The Treasurer

and 21 other members – all elected by the General Body by single non-transferable vote.  If any member of the ACT is a member of the Senate or Syndicate of the University, that member will be an ex-officio member of the Executive Committee.

 

  1. The tenure of the Executive Committee shall be one year or till the date of election of the next Executive Committee whichever is earlier. However, the General Body can by a resolution extend the term of the Executive Committee by three months in exceptional cases.

 

  • The powers and functions of the Executive Committee shall be as follows:
  1. to manage the affairs of the ACT in accordance with the Bye-laws and the resolutions of the General Body,
  2. to raise funds by way of membership fees, subscription, donations and grants and administer the funds of the ACT,
  3. to incur expenditure and prepare the annual statement of accounts for presenting to the General Body for approval,
  4. to prepare the annual budget of expenditure for the consideration and approval of the General Body,
  5. to appoint sub-committees, panel from among the members for specific purposes,
  6. to nominate representatives of ACT to serve on different bodies and to co-ordinate their activities that are conducive to the achievements, aim and objectives of the ACT
  7.  
  8. a) The Executive Committee shall meet as and when required, but there shall be at least one meeting in every two months.
  9. b) A meeting of the Committee can be called by the President, by the Secretary

     or by the written requisition of twelve members of the Committee.

  1. c) A minimum notice of three days should be given for all ordinary meetings of

     the Committee, but in urgent situations the President or the Secretary can

     convene a meeting with shorter notice.

  1. d) The decision of the Committee shall be taken with simple majority of votes of

      those present and voting.

 

  1. Powers and functions of the President:

The President shall preside over all the meetings of the Committee and General Body and give direction for the functioning of the ACT.

 

  1. Powers and functions of the Vice-President:

The Vice-President shall assist the President in all matters relating to the ACT and shall perform the duties of the President in the absence of the latter.

 

  • Powers and functions of the Secretary:

The Secretary shall:

  1. issue notices of the meetings of the Committees and the General Body,
  2. keep the minutes of the meeting and present them for ratification at the next meeting,
  3. keep the records of all the proceedings of the ACT,
  4. to sign on behalf of the ACT on all documents,
  5. to conduct the correspondence of the ACT,
  6. to arrange for the purchases of the ACT and to be responsible for the stock, and
  7. to prepare annual budget and annual report for presentation in the Committee.

 

  • The Powers and functions of the Joint-Secretaries:

The joint-Secretaries shall assist the Secretary in all matters related to the ACT and perform the duties of the Secretary in the absence of the latter with the approval of the Executive Committee.

 

 

  1. The powers and functions of the Treasurer:

The Treasurer shall accept money and issue receipts on behalf of the ACT keep the accounts and prepare annual financial statement and present in the annual general body meeting of the ACT.

 

  1. Internal Auditor:

A member of the ACT shall be nominated as Internal Auditor, who shall be in no case a member of the Executive Committee, by the previous General Body to the Annual General Body to audit the annual accounts of the Association.

 

Elections

The election of members of the Executive Committee shall be held in the Annual General Body meeting of every year.  The procedure for election shall be decided by the General Body.

  1.  i)Elections shall be governed by a Returning Officer who will be appointed by the previous general body to the annual general body. The Returning Officer in consultation with the Executive Committee will prepare the schedule for elections which will be completed before the completion of the annual general body.

Funds

All funds and properties of the ACT shall be managed by the Executive Committee.

  1. ii) The Executive Committee shall arrange for opening an account with a nationalized

        bank/Calicut University Employees Housing Co-operative Society.  The account

         shall be operated jointly by the Secretary and Treasurer of the ACT.

iii)    The Secretary shall have a permanent imprest of Rs.500/- (Rupees five hundred

         only).

  1. iv) The accounts shall be audited annually by an auditor elected from among the

         members by the General Body.

Amendments to Bye-law:

Amendment to these Bye-laws can be made by the General Body provided the proposed amendment is included in the agenda and circulated with the notice of the   meetings.  Such proposals should be supported by not less than fifty percent of the total membership of the General Body.

  1. ii) Any amendments to the Bye-laws shall specify the date from which the amendment will take effect.

Dissolution

The ACT can be dissolved by a resolution of the General Body specifically called

        for the purpose on a written requisition by at least on third of the members, provided   the resolution for the dissolution is supported by two thirds of the total membership  and three fourth of the members present and voting.

  1. ii) When the ACT is dissolved, the assets of the ACT will be transferred to

        Associations with similar aims and objectives or to charitable trusts as decided in  

        the resolution for the dissolution.

The  Association of Calicut University Teachers (ACT)is strongly opposed to the devious politics based on caste and religion currently practiced by all political parties.
